De song is gebaseerd op het waar gebeurde verhaal van Richard Loving, een blanke, die in 1967 trouwde met Mildred Jeter, een zwarte vrouw, in Virginia. Gemengd huwelijk was toen nog verboden en het echtpaar werd veroordeeld tot 1 jaar cel.
Deze zaak was het begin van de strijd voor gelijke rechten voor gemengde huwelijken. Langzaam veranderden de Amerikaanse Staten hun wetheving. De laatste Staat was Alabama, waar in 2000 eindelijk het gemengde huwelijk officieel werd toegelaten.
Richard Loving was toen al overleden. Hij stierf in 1975 - hij was toen 41 - toen een dronken automobilist hem aanreed. Mildred Loving overleed in 2008.
